Terms & Conditions

These Terms constitute a binding agreement between you and SIGMASIX. They apply to every download, installation, and use of the Apps, including any updates we make available, regardless of the distribution channel through which you obtained them.

If you do not agree with any part of these Terms, you must not download, install, or use the Apps.

Where you obtain an App through a third-party distribution platform (Apple's Mac App Store, Polar.sh, or another channel), the terms of that platform also apply to your purchase or download. In case of conflict between these Terms and a platform's mandatory terms regarding the transaction itself (payment, refund, account management), the platform's terms prevail for that specific aspect.

Subject to your compliance with these Terms, SIGMASIX grants you a non-exclusive, non-transferable, revocable license to install and use the Apps for your personal or internal professional purposes, on the devices you own or control, in accordance with the terms of the distribution platform through which you acquired the App.

This license does not transfer any ownership rights. The Apps are licensed, not sold. SIGMASIX retains all rights, title, and interest in and to the Apps, including all intellectual property rights, except for the limited rights expressly granted to you in these Terms.

Except to the extent expressly permitted by mandatory applicable law (in particular for interoperability purposes), you must not:

• copy, redistribute, sublicense, rent, lease, lend, or sell the Apps;
• decompile, disassemble, reverse-engineer, or attempt to derive the source code of the Apps;
• modify, adapt, translate, or create derivative works based on the Apps;
• remove, obscure, or alter any copyright, trademark, or proprietary notices contained in or on the Apps;
• use the Apps in violation of any applicable law or regulation, or in any manner that infringes the rights of third parties.

The Apps are distributed through the following channels:

• Mac App Store — operated by Apple Inc. Purchases, refunds, and account management are handled by Apple under its own terms of service.
• Polar.sh — operated by Polar Software, Inc. Purchases, refunds, and account management are handled by Polar under its own terms of service.
• Direct download from sigmasix.ch — for free apps and the AppleScripts collection only.

SIGMASIX is the publisher of the Apps but is not a party to the transaction between you and the distribution platform. For any matter relating to billing, payment processing, or refunds, please refer to the platform's own policies in the first instance.

Where a free trial is offered (currently for Syphoner and ProjectorManager), it is provided on an "as is" basis solely to allow you to evaluate the App before purchase. The trial may be subject to functional limitations, time limits, or both.

It is your responsibility to test the App during the trial period and to confirm that it meets your needs before completing a purchase. Refunds, where applicable, are governed by the policy of the distribution platform through which you acquired the App.

SIGMASIX may, at its sole discretion, release updates, patches, and new versions of the Apps, including to fix issues, improve performance, or add features. Updates are typically delivered through the distribution platform on which you acquired the App.

Use of major new versions may, in some cases, require a separate purchase. Where this is the case, it will be clearly indicated.

Unless explicitly stated otherwise in writing, technical support is not included in the license. SIGMASIX provides no service-level commitment regarding the availability or response time of any informal support that may be offered.

To the fullest extent permitted by applicable law, the Apps are provided "as is" and "as available", without any warranty of any kind, whether express, implied, or statutory. SIGMASIX does not warrant that:

• the Apps will operate without interruption or error;
• the Apps will meet your specific requirements or expectations;
• any defects or errors in the Apps will be corrected;
• the Apps are compatible with any particular hardware or software configuration not explicitly listed in the requirements.

Where a free or trial version of the App is available, you are responsible for evaluating it and confirming its suitability for your needs before purchase.

To the fullest extent permitted by applicable law, SIGMASIX, its officers, employees, and agents shall be liable only in cases of intent or gross negligence.

In no event shall SIGMASIX be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of profits, loss of use, loss of data, business interruption, or reputational damage, arising out of or in connection with the Apps, even if SIGMASIX has been advised of the possibility of such damages.

Where liability cannot lawfully be excluded, it shall be limited to the amount actually paid by you for the App giving rise to the claim during the twelve (12) months preceding the event.

The Apps must not be used for any unlawful purpose, nor in connection with any high-risk activity in which a defect of the App could foreseeably lead to death, personal injury, or serious environmental damage. This includes, without limitation, the operation of life-support systems, aircraft navigation, nuclear facilities, or any safety-critical infrastructure.

All works produced by SIGMASIX, including the Apps and any documentation, screenshots, icons, and accompanying materials, are protected under Swiss intellectual property law and the relevant international treaties.

You agree to take reasonable steps to prevent any unauthorised copying, distribution, or modification of these works. You must not remove or obscure any copyright notice or other indication of ownership contained in or on the Apps.

Unless expressly agreed otherwise in writing, all intellectual property rights relating to the Apps remain the exclusive property of SIGMASIX. No transfer of ownership is implied by the grant of a license under these Terms.

The Apps may include third-party software components or frameworks (such as the Syphon framework). The use of such components is subject to their respective licenses, which are made available within the App or upon request.

The AppleScripts collection published on this website is released under the MIT License. The provisions of these Terms relating to license restrictions (§ 3), no-warranty (§ 7), and limitation of liability (§ 8) apply to the AppleScripts in addition to the MIT License terms.

You are free to use, modify, and redistribute the scripts, including in commercial projects, provided you retain the original copyright notice in any substantial copy.

Neither party shall be liable for any breach of these Terms caused by events beyond its reasonable control, including but not limited to fire, explosion, war, hostile actions, acts of government or other competent authorities, natural disasters, or major service outages of third-party platforms or infrastructure.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. The parties shall negotiate in good faith a replacement clause that reflects, as closely as possible, the original intent of the invalid provision.

SIGMASIX reserves the right to amend these Terms at any time. The current version is the one published on this page. Material changes will be indicated by an updated revision date at the top of the page. Continued use of the Apps after such changes constitutes acceptance of the revised Terms.

These Terms, and any rights and obligations of the parties arising from them, are governed by and construed in accordance with Swiss law, to the exclusion of its conflict-of-law rules and of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute arising out of or in connection with these Terms or the use of the Apps shall be submitted to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland, subject to the right of appeal to the Swiss Federal Supreme Court in Lausanne.
